TERMS OF SERVICE

The terms and conditions that govern your use of F.I.T.S. Health Clubfacilities, memberships, bookings, and online orders.
1. Acceptance of Terms
By accessing or using the facilities, services, website, or mobile tools of F.I.T.S. Health Club ("F.I.T.S.", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services. We may revise these Terms at any time, and continued use of our services after changes constitutes acceptance of the updated Terms.
2. Eligibility & Health Representation
You represent that you are at least 16 years of age (or have parental consent where required) and are physically able to participate in fitness, training, cold plunge, sauna, and recovery activities. You acknowledge that you have consulted a physician regarding your fitness to use our services and that you will disclose any medical conditions, injuries, or limitations that may affect your participation.
3. Memberships & Billing
Membership fees are billed on a recurring basis according to the plan you select. You authorize us to charge your payment method for all applicable fees until you cancel. Cancellations must be submitted in writing or through your account and take effect at the end of the current billing cycle. Fees are non-refundable except where required by law. We may change our pricing with reasonable advance notice.
4. Bookings, Classes & Recovery Sessions
Class spots, cold plunge slots, and recovery suite sessions are subject to availability and may require advance booking. Late cancellations (less than 12 hours before) or no-shows may result in a fee or loss of the session credit. We reserve the right to cancel or reschedule sessions due to maintenance, weather, or unforeseen circumstances.
5. Facility Conduct & Safety
You agree to follow all posted rules, staff instructions, and safety guidelines while on premises. This includes proper use of equipment, hygiene protocols, time limits on plunge and sauna use, and respectful behavior toward staff and other members. We may suspend or terminate access for conduct that is unsafe, disruptive, or violates these Terms.
6. Online Orders & Pickup
Supplements, meals, shakes, and passes purchased through our online shop are subject to availability. Prices and descriptions are listed in USD and may change without notice. Fresh meals and blended shakes are prepared for in-club pickup and are non-returnable. If an item is unavailable or incorrect, contact the front desk and we will make it right.
7. Assumption of Risk
Use of fitness equipment, cold plunge, infrared sauna, and recovery machines involves inherent risks including but not limited to injury, strain, dehydration, or adverse physical reactions. You voluntarily assume all such risks and acknowledge that you are participating at your own risk. You agree to follow all instructions and stop any activity that causes discomfort.
8. Release & Limitation of Liability
To the fullest extent permitted by law, you release F.I.T.S. Health Club, its owners, staff, and affiliates from any claims, damages, or liabilities arising from your use of our services, except where caused by our gross negligence or willful misconduct. Our total liability for any claim is limited to the amount you paid us for the service giving rise to the claim.
9. Intellectual Property
All content on this website, including logos, text, graphics, and imagery, is the property of F.I.T.S. Health Club or its licensors and is protected by intellectual property laws. You may not copy, reproduce, or distribute our content without prior written permission.
10. Third-Party Services
Our website may integrate third-party tools such as chat widgets, payment processors, and scheduling platforms. These services are governed by their own terms and privacy policies, and we are not responsible for their practices or performance.
11. Termination
We may suspend or terminate your access to our services or facilities if you violate these Terms, fail to pay applicable fees, or engage in conduct we deem harmful. Upon termination, all recurring billing stops, and no refunds are issued for the current period except where required by law.
12. Governing Law & Disputes
These Terms are governed by the laws of the jurisdiction in which our facility operates, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our services will be resolved through good-faith negotiation, and if unresolved, through binding arbitration in that jurisdiction.
